6. Capital gains tax claim service (Plusvalía)

➢ WHAT IS PLUSVALÍA?
The municipal capital gain or IIVTNU (Tax on the Increase in the Value of Urban Land) is a municipal tax that taxes the increase in value experienced by urban land.

➢ IS IT CLAIMABLE?
Currently, the municipal farms consider in all cases the increase in the value of the land between the dates of acquisition and sale of any urban property (urban land, single-family homes, flats, premises, garages, etc.). However, the loss of land value in transactions between 1995 and the present is demonstrable, depending on the location of the property, allowing the TAX CANCEL. To cancel said tax, a legal document will be required stating the case and alleging the loss of land value, as well as an expert report that justifies said loss individually.

➢ WHEN DO I NEED THE EXPERTISE REPORT?
The tax will be justifiable within 30 days after the transaction in case of inter-live transmissions, and 6 months in transmissions due to death. It will be possible to recover the tax already paid up to a period of 4 years after the self-assessment.

➢ HOW DO I KNOW IF CLAIM IS VIABLE?
In order to advise you on the feasibility of claiming your surplus value, we will need to know the municipality where the property is located, date of acquisition and date of transmission. If we can prove the loss of land value, the tax cancellation will be viable.
